01These terms
These terms form a contract between you and [registered company name], company number [number], registered at [registered address], trading as Second Wind.
By subscribing to a membership or using this website, you accept these terms. If you do not accept them, please do not subscribe.
These terms are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction.
02What the service is
Second Wind is a managed, done-for-you job search. For as long as you are a member, on every working day, we:
- Find live roles and score each one against your real experience and the guardrails you set.
- Re-engineer your CV and write a cover letter for each role we apply to.
- Submit applications in your name, across job boards and employer portals.
- Answer employer screening questions on your behalf, using answers you have approved.
- Keep a dashboard of everything we have sent and every response, refreshed once every 24 hours on working days.
- Produce a researched interview playbook when an interview is booked.
What we will not do
We will not invent, inflate or imply experience, qualifications, tools, clearances or years you do not have. We reframe what is genuinely in your history and nothing more. If a role requires something you do not have, we will tell you rather than paper over it. This is not negotiable, including if you ask us to.
03What we do not promise
We do not guarantee that you will get a job, an interview, or any employer response. No one honestly can. Hiring decisions belong entirely to employers and depend on factors outside anyone's control.
Specifically:
- Published application volumes are indicative ranges, not guarantees or quotas. Where genuinely suitable roles are scarce for your profile we will tell you within the first fortnight of that month and propose options, and we will not apply to unsuitable roles in order to reach a number.
- Market statistics we publish, such as callback rates or average search length, are general market context. They are not a prediction of your result.
- We do not promise to beat, bypass or trick applicant tracking systems. We write truthfully, using the language of the posting, so that a human being sees your application.
04Membership, price and payment
- There are two ways to buy, and they are different contracts.
- Try us once is a single payment of £99 for around 50 tailored applications, delivered over approximately two weeks from the date your onboarding form is complete. It does not renew, there is no subscription, and no further payment is taken. If you upgrade to Managed Campaign within 14 days, we credit the £99 against your first month.
- Managed Campaign is £199 per month at the founding rate, billed monthly in advance through Stripe, with a floor of typically 120–200 applications per billing month.
- The founding rate applies to Managed Campaign only and is limited to the first 30 members. If you take a founding seat, that price is locked for as long as your membership runs without interruption, even when we raise prices for new members.
- If you cancel and later rejoin, the founding rate does not carry over. You rejoin at the price then current.
- Prices include VAT where applicable. [Confirm your VAT position and state it plainly here.]
- If a payment fails we will retry and contact you. Work pauses if an invoice remains unpaid after 7 days.
05Cancelling
- Try us once has nothing to cancel — it ends when the 100 applications are delivered. If you are hired partway through and want us to stop, tell us and we will, and we will refund the unstarted portion pro-rata.
- On Managed Campaign you can cancel at any time, including the day you are hired. Email hello@secondwind.careers or use the link in your billing emails.
- Cancellation takes effect at the end of the current billing month. We do not pro-rate part months, and we keep working for you until the period ends.
- Statutory right to cancel. As a consumer buying online you normally have 14 days to change your mind. Because the service starts immediately, we ask you to agree that we begin work inside that period. If you then cancel within 14 days, you may be charged a proportionate amount for the work already done, and you lose the right to cancel once the service has been fully performed.
06What we commit to, and what we don't
We do not guarantee outcomes, and we do not guarantee volumes
No provider can honestly promise you a job. Less obviously, we also will not promise a fixed number of applications per month — because the only way to hit a guaranteed number in a quiet month is to apply to roles you would not accept, and not doing that is a commitment we would rather keep.
What we do commit to
- To work your search on every working day of your membership, to the standard published at how we work.
- To apply only to roles that genuinely match the specification you set, and never to pad the count with roles that do not.
- To show you every application we send, along with the CV that went with it, on your dashboard.
- To tell you within the first fortnight of any month in which genuinely suitable roles are scarce for your profile, and to come to you with options rather than a silence.
- To use reasonable skill and care throughout, as required by the Consumer Rights Act 2015.
Indicative volumes
We publish typical ranges — around 120 to 200 tailored applications a month on Managed Campaign, and around 50 on Try us once. These are indicative ranges based on our experience, not contractual commitments, and the actual figure depends on how many suitable roles are live for your profile.
If we get it wrong
If we have not done the work described above, tell us at hello@secondwind.careers and we will put it right — by completing the work, by crediting the month, or by refunding it, whichever is appropriate. We will respond within 5 working days. This is in addition to, and does not affect, your statutory rights.
No lock-in
There is no minimum term and no notice period on Managed Campaign. You may cancel at any time, including the day you are hired, and you will not be charged again. Try us once does not renew at all.
[Have your solicitor confirm this section, particularly the service-standard wording, before publishing.]
6bEmployer engagements
Where an employer funds a programme for people leaving their organisation, the following also applies.
- The employer is our customer; the participant is the person we serve. Both relationships are set out in the engagement letter and in each participant's consent.
- Participation is voluntary and requires the individual's explicit written consent. No one is enrolled by their employer alone. A participant may stop at any time without giving a reason, and without the employer being told why.
- The employer receives aggregate reporting only — enrolment, take-up, applications sent, responses, interviews, offers and median days to first interview. The employer never receives an individual's applications, target roles, or the identity of employers who declined them. We tell every participant this at the start.
- The application allocation is pooled across the cohort rather than fixed per person. Unused allocation is not refundable and does not carry beyond the engagement term.
- Term. Six months per participant from their onboarding date, unless the engagement letter says otherwise.
- Data protection. Where the employer funds and instructs the programme we generally act as a processor on their behalf, with our operators as sub-processors. We will sign the employer's data processing agreement or provide ours. See the privacy notice and security page.
- Payment. Invoiced against a purchase order where required, payable within 30 days unless agreed otherwise. Programmes begin once the engagement letter is signed and participants have consented.
- Founding client rate. Early engagements may be discounted in exchange for a named case study. Any such discount, and the trigger that ends it, is stated in writing in the engagement letter.
Before you publish this
Employer engagements are B2B contracts and this section is a summary, not an engagement letter. Have a UK commercial solicitor draft the engagement letter and the data processing agreement before signing a first cohort.
07Your side of it
For the service to work, you agree to:
- Give us accurate and truthful information about your experience and qualifications. You warrant that everything you give us is true and that you are entitled to work in the locations you are targeting. We rely on this completely.
- Authorise us to act in your name for the purpose of applying for roles, including creating accounts, completing applications and corresponding with employers about applications. You confirm you have the right to give this authority.
- Respond to items marked "Your part" on your dashboard. Some portals will only accept a submission from you personally, and we cannot complete those for you.
- Tell us promptly if you accept an offer, withdraw from a process, or change your search preferences.
- Keep your dedicated search email and any credentials you share with us secure at your end.
- Not ask us to misrepresent your experience, apply to roles you know you are not entitled to hold, or do anything unlawful.
If you give us inaccurate information and an employer withdraws or an offer is rescinded as a result, that is not a failure by us and the delivery promise in section 6 does not apply.
08Acceptable use
You may not use Second Wind or this website to break the law, to infringe anyone's rights, to send anything harmful or misleading, to scrape or reverse-engineer any part of the service, or to resell the service to someone else. One membership covers one person's job search. We may suspend or end a membership immediately for a serious or repeated breach.
09Intellectual property
The Second Wind name, logo, website, dashboard, prompts, scoring methodology, templates and operating materials are ours and stay ours. Nothing here gives you a licence to reuse them beyond your own job search.
Your documents are yours. The tailored CVs, cover letters and interview playbooks we produce for you belong to you, and you can keep and use them after you leave. You grant us a licence to use your material only to provide the service.
We may describe outcomes anonymously, for example "a business analyst in London". We will not name you, quote you or use your logo, employer or likeness in marketing without your specific written permission.
10Liability
Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be limited. Your statutory rights as a consumer are not affected.
Subject to that:
- We are not liable for loss of a job, an offer, earnings, opportunity or reputation, or for any indirect or consequential loss.
- We are not liable for the acts, decisions or data handling of employers, job boards or recruiters.
- Our total liability to you in any 12-month period is limited to the total fees you paid us in that period.
The service is provided with reasonable care and skill. We do not warrant that job boards, portals or third-party systems will be available or error-free.
11Suspending or ending your membership
We may pause or end a membership if fees are unpaid, if you breach these terms, if you ask us to do something dishonest or unlawful, or if the working relationship has broken down. Where we end it without cause, we will refund any unused part of the month.
On ending, we deactivate your dashboard, destroy portal credentials within 30 days, and retain your records as set out in the privacy notice. You can request a copy of your documents at any point before deletion.
12General
If any provision of these terms is found unenforceable, the rest continues in force. Our failure to enforce a term is not a waiver of it. No one other than you and us has any right to enforce these terms.
We may update these terms. For material changes affecting existing members we will give at least 30 days' notice by email, and you may cancel before the change takes effect.
Complaints go to hello@secondwind.careers and we will acknowledge within 2 working days.
Before you publish this
These terms were written around how Second Wind actually operates, but they are not legal advice. Complete every placeholder, confirm your VAT and consumer-cancellation position, and have a UK commercial solicitor review sections 5, 6, 7 and 10 in particular before going live.
You rest. We apply. You interview.
That is the deal, and the pricing behind it is published in full — £99 to try it once, £199 a month to hand it over, cancel any time.
